Event Waiver
By making a purchase, you agree to a WAIVER FOR AND IN CONSIDERATION of SEPHARDIC TRADITION AND RECREATION, INC., a California nonprofit public benefit corporation, and its affiliates (hereinafter collectively referred to as “STAR”) permitting the attending student, to utilize use and/or participate in the facilities, equipment, services, activities and programs of STAR for any purpose, including, but not limited to observation, use of the facilities or equipment, receiving instruction, training, or supervision, transportation to and from as well as accommodations at the location or locations and participation in any program with, on behalf of, or affiliated with STAR (all of which are hereinafter collectively referred to as “STAR Activities”), the UNDERSIGNED, for himself or herself as the Participant, or as parent(s) or guardian(s) of the Participant and on behalf of any personal representatives, heirs, and next of kin of the Participant, hereby agree(s) and represent(s) as follows:
1. EACH OF THE UNDERSIGNED (purchaser), ON HIS/HER/THEIR BEHALF OR AS PARENT(S) OR GUARDIAN(S) ON BEHALF OF THE PARTICIPANT, HEREBY RELEASE(S), WAIVE(S), DISCHARGE(S), AND COVENANT(S) NOT TO SUE STAR OR ITS AFFILIATES, their directors, officers, employees, volunteers and agents (hereinafter referred to as “Releasees”) for any and all liability to the undersigned and the Participant and all of their respective personal representatives, assigns, heirs, and next of kin, for any loss or damage, and any claim or demands therefor on account of injury to the Participant or the Participant’s property or the property of the undersigned, or resulting in death of the Participant, whether caused by the negligence of the Releasees or otherwise, while the Participant is in, upon, or about any STAR related premises or facilities, or using any STAR-related equipment or participating in any program affiliated with STAR, including without limitation, transportation to and from STAR Activities. In consideration of accepting the registration and permitting the voluntary participation of the Participant in STAR activities, for myself/ourselves and on behalf of the Participant, I/we hereby release, discharge and agree to hold harmless STAR, its affiliates and their officers, directors, employees, agents, volunteers and officials from any and all claims, demands, costs, expenses, and compensation arising out of or in any way related to any injury or damage that may result to the Participant, including any physical or other injury or death caused by the negligence of any person or property described above.
2. THE UNDERSIGNED (purchaser) HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to the Participant due to the negligence of any or all of the Releasees or otherwise, while in, about, or on any premises associated with STAR and/or while using any premises, facilities or equipment or participating in any program affiliated with STAR, including without limitation, transportation to and from any of STAR Activities. The UNDERSIGNED, for myself/ourselves and on behalf of the Participant, our respective heirs, assigns and next of kin, willingly and voluntarily accept(s) and assume(s) all such risk.
3.The UNDERSIGNED (purchaser) further expressly agrees that the foregoing RELEASE AND WAIVER OF LIABILITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Any disputes will be litigated in the County of Los Angeles and the prevailing party is entitled to reasonable attorney fees and costs.
4. REGARDING THE COVID-19 VIRUS, without limitation on any of the foregoing, the UNDERSIGNED (purchaser) agrees that he/she and/or the Participant is personally responsible for his/her safety while participating in any STAR Activities, and agrees to comply with all STAR policies and rules, including but not limited to guidelines, signage and instructions. Because STAR Activities will be open to other individual participants, the UNDERSIGNED (purchaser) recognizes that he/she and/or the Participant is at a higher risk of contracting the COVID-19 virus. With full awareness and appreciation of the risks involved, the UNDERSIGNED (purchaser), for himself/herself and/or the Participant, and on behalf of his/her and the Participant’s family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives (collectively “the Releasing Parties”), hereby forever releases, waives, discharges, and covenants not to sue STAR, its board members, officers, agents, employees, independent contractors, affiliates, successors, and assigns (collectively “the Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by any of the Releasing Parties related to COVID-19, whether caused by the negligence of the Released Parties, any third-party participating in STAR Activities, or otherwise, while participating in any of the STAR Activities in, on, or around STAR facilities or other locations, and/or while using any STAR facilities, tools, equipment, or materials.
5.By purchasing, UNDERSIGNED (purchaser) acknowledges and represents that he/she has read the foregoing Release and Waiver of Liability Agreement, understands it and signs it voluntarily as his/her own free act., and that he/she is sufficiently informed about the risks involved in the STAR Activities to decide whether to sign this document.
THE UNDERSIGNED (purchaser) IS OF LEGAL AGE, HAS READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, AND FURTHER AGREES THAT NO ORAL MODIFICATIONS, REPRESENTATIONS, STATEMENTS OR INDUCEMENT APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE.
Event Cancellation & Refund Policy
Sephardic Tradition & Recreation (STAR) reserves the right to refuse/cancel registrations. If STAR refuses a registration, registrants will be offered a refund.
Event Cancellation by STAR
STAR reserves the right to cancel an event due to low enrollment, inclement weather or other circumstances which would make the event non-viable. If STAR cancels an event, registrants will be offered a full refund. Should circumstances arise that result in the postponement of an event, registrants will have the option to either receive a full refund or transfer registration to the same event at the new, future date.
Registration Cancellation by Participant
Refunds will not be available for registrants who choose not to attend an event. In the case of an emergency or illness, cancellations for credit will be considered if the following criteria are met. A note must be sent from a doctor, teacher or any other applicable party, in writing or via email to rabbi@lastar.org explaining the situation. This must be received no later than 24 hours before the start of the event and will be evaluated by STAR on a case by case basis. All credit requests must include the name of the attendee and/or order number. Cancellations received after the stated deadline will not be eligible for credit.
